Recent Trial Verdict: Bob Sutherland

Bob Sutherland was successful during a recent trial in Hamilton. The Plaintiff alleged McMaster University failed to properly maintain and supervise a running track on campus, after he was injured by another runner while using the facilities. After 10 days of trial, the jury returned a verdict finding no liability on McMaster University.

On January 18, 2018, Bob Sutherland successfully argued a summary judgment motion on behalf of the University of Western Ontario. Justice Kershman, in granting the motion, found the University did not owe a duty of care to an adult student who was independently partaking in non-academic activities while abroad on academically-related travels.

Burl’s Creek Approved for Camping and Parking

Burl’s Creek, the host site for the Boots & Hearts country music festival located north of Barrie, received approval for camping and parking on lands adjoining its event grounds. The OMB approved the temporary seasonal use recognizing that the site would continue to be used for agriculture.

Restoration Hardware Gets Liquor Licence

Nick Macos was successful in obtaining a licence to serve alcohol within Restoration Hardware’s new design store at Yorkdale Mall. For the first time in Ontario, patrons of the store can enjoy a glass of Chardonnay or their favourite beverage while shopping.

RSM Canada: Bob Sutherland on Black Sutherland’s growth

Bob Sutherland recently spoke with RSM Canada about the start and growth of Black Sutherland LLP. Black Sutherland LLP was started in 1922. Bob Sutherland joined the firm in 1985, which at that time only had 4 lawyers. Since 1985, the firm has grown and expanded to now have about 18 lawyers.

Nicholas T. Macos completes the divestiture of the Port Stanley Harbour from Transport Canada to the Municipality of Central Elgin. The transaction vests the Municipality with substantial waterfront property to be remediated by Transport Canada for parkland purposes and a fund of over $13.5 Million to address future infrastructure requirements.

In a motion brought on behalf of the defendants after the jury retired to render its verdict, our firm was successful in obtaining an order that the plaintiff has failed to satisfy the threshold that she sustained a permanent and serious impairment arising from the motor vehicle accident.
